Ask for the state’s appraisal

One of the best ways to push back against an eminent domain notice is to ask for the appraisal that their offer was based on. This way, you can make sure that you are getting the best possible deal if you are forced to concede on the eminent domain case, or you can fight that the state isn’t acting in good faith when you are arguing your case. Don’t tell the state how much you think your property is worth

If you give your own estimate (educated or not) on how much you think your property is worth, this can be used against you later to undersell your position which can cost you a lot of money. Just remember to not say anything about the value of your land, because it can be much more than you give it credit for.

Ask about relocation expenses

If the property being seized is part of your work or home, you may be entitled to relocation reimbursement. In fact, this is something that the condemner purposefully does not bring up in hopes that you will never think to ask about it. So always ask if this is something that would be available to you.

Don’t accept their initial offer

In many cases, people facing eminent domain feel a little nervous about fighting their case against the government to get more money from their property, and for a good reason. Eminent domain can be a very scary thing to face, and many just look to get out as soon as possible.

It’s important to remember, however, that the state will purposefully give you a low offer in the hopes that you take it and move on without a fight. Before you accept their offer, take it to a specialized eminent domain attorney who will be able to advise you on the next steps to make sure you get as much money as possible.
